FANG Terms of Service

1. Acceptance of Terms

By creating an account or using FANG, you confirm you are at least 13 years old (or the age of digital consent in your jurisdiction) and agree to these Terms and our Privacy Policy.

If you are under 18, you represent that you have permission from a parent or legal guardian. If you do not agree, do not use the Service.

2. Relationship to Community Rules

Our Covenant of the Crypt describes community expectations and content standards. The Covenant supplements these Terms. A violation of the Covenant may result in content removal, account restrictions, or termination under these Terms.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You must provide accurate information and keep your profile reasonably up to date.
• Invitation codes and waitlist approvals may be required to register. Misuse of codes or false registration information is prohibited.
• We may suspend or terminate accounts for violations, fraud, abuse, or risk to the community or platform.

4. User Content

• You retain ownership of content you post (reviews, discussions, images, listings, messages, etc.), subject to the license below.
• By posting or uploading content, you grant FANG a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and adapt your content solely to operate, promote, and improve the Service (including backups and moderation).
• You represent that you have the rights to post your content and that it does not infringe others' intellectual property or privacy rights.
• Content must comply with our rules: no spam, harassment, illegal content, prohibited AI-generated material (where stated in the Covenant), or content that violates copyright or trademark law.

5. Prohibited Conduct

• No advertising, self-promotion, or commercial activity except through approved marketplace, merch, or other features we expressly provide.
• No scraping, bots, automated access, or circumvention of technical limits without our written permission.
• No impersonation, fraud, phishing, or attempts to access other users' accounts.
• No interference with the Service, other users, or our infrastructure.
• Respect the retro, community-first spirit — keep interactions authentic and constructive.

6. Fang Points and Rewards

• Fang Points are virtual rewards with no cash value and are not property, currency, or a stored-value account.
• Points may be earned, spent, or adjusted according to platform rules and membership tiers.
• We may modify, suspend, or terminate the points system, multipliers, or redemption options at any time, with or without notice, to the extent permitted by law.
• Points balances are not transferable except as the Service explicitly allows.

7. Memberships, Merch, and Marketplace

Certain features involve paid memberships, official merch, digital goods, or peer-to-peer marketplace transactions.

• Payments are processed by third-party providers (such as Square). We do not store full payment card numbers on our servers.
• Prices, taxes, shipping charges, and availability are shown at checkout. For marketplace sales, a platform fee applies to the pre-tax subtotal (item plus shipping) as described at checkout and in seller disclosures.
• Marketplace sellers must provide accurate listings, honor approved sales, and ship items as described. Seller payouts are subject to our vendor approval, order completion, delivery confirmation, and payout policies.
• Shipping estimates may be provided via third-party carriers (such as Shippo). Actual costs and delivery times are not guaranteed.
• Purchases are generally final except where required by law or where we expressly offer refunds or cancellations (for example, eligible order cancellations per platform rules).
• Points may not be used to pay shipping fees where the Service requires card payment for shipping.
• By listing or buying, you agree to applicable seller and buyer obligations shown at checkout, including acceptance of the Covenant where required.

8. Intellectual Property

FANG, The Fang App, our logos, branding, site design, and underlying software are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works from our proprietary materials without permission.

If you believe content on the Service infringes your copyright, contact us at nosferatu@thefang.email with: identification of the work, the infringing material and its location, your contact information, a good-faith statement, and your signature (physical or electronic). We may remove or disable access to allegedly infringing material and terminate repeat infringers where appropriate.

9. Third-Party Services and Links

The Service may integrate with or link to third-party sites, payment processors, shipping tools, media hosts, and other services. Those services have their own terms and privacy practices. We are not responsible for third-party services or content.

10. Privacy

Our Privacy Policy explains how we collect, use, and share information. By using the Service, you consent to those practices.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access, remove content, or restrict features at our discretion if we believe you violated these Terms, the Covenant, applicable law, or pose a risk to users or the platform.

Sections that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and indemnification) will survive.

12. Promotions and Giveaways

FANG may run contests, giveaways, or promotions from time to time.

• Participation is voluntary and governed by the specific rules posted for each promotion.
• Prizes are provided "as is" with no warranty. We are not responsible for prize fulfillment issues, changes in prize value, or any losses incurred by winners (including travel, taxes, or changes in third-party provider policies such as Disney World tickets).
• For Disney World ticket giveaways: Tickets are subject to Disney's official terms. Unused tickets may be transferable before first use; once scanned, they are non-transferable. We will coordinate with the winner, but availability and dates are not guaranteed.
• FANG is not affiliated with, endorsed by, or sponsored by The Walt Disney Company or any of its affiliates. Disney, Walt Disney World, and related names, logos, and marks are trademarks and property of Disney. All rights reserved by Disney and its licensors.
• Winners are responsible for all taxes, travel, and additional expenses related to claiming or using the prize.
• We reserve the right to cancel, modify, or disqualify entries for any reason.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted, secure, or error-free operation. User content and marketplace transactions are primarily between users; we do not warrant the quality, safety, legality, or accuracy of user listings or conduct.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FANG AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

15. Indemnification

You agree to defend, indemnify, and hold harmless FANG and its operators from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, your marketplace activity, or your violation of these Terms or applicable law.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Wisconsin, USA, without regard to conflict-of-law principles.

Except where prohibited, you agree that disputes will be brought in the state or federal courts located in Wisconsin, and you consent to their jurisdiction.

17. Changes to Terms

We may update these Terms from time to time. We will post the revised Terms with an updated "Last Updated" date. Material changes may also be communicated through the Service or by email where appropriate.

Continued use after changes become effective constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.

18. General

• These Terms, together with the Privacy Policy and Covenant where applicable, are the entire agreement between you and FANG regarding the Service.
• If any provision is held invalid, the remaining provisions remain in effect.
• Our failure to enforce a provision is not a waiver of our right to do so later.
• You may not assign your rights under these Terms without our consent. We may assign our rights as part of a merger, acquisition, or sale of assets.
